You may not supply Topshelf with any images, designs, or other material protected by copyright without the permission of the actual copyright owner. By approving a proof with such images, designs, or other material, the approving party warrants and represents that:

1. It owns all of the copyright in such images, designs, or other material;

2. It has received permission from the person or entity who owns the copyright in such images, designs, or other material; or

3. That the images, designs, or other material are in the public domain.

The approving party further warrants and represents that it otherwise has the full and unencumbered right to provide such images, designs, or other material and that such providing, or any use by Topshelf Merch, will not infringe any rights or interests of others and the supplying party agrees to indemnify Topshelf Merch for all damages awarded against and all attorneys’ fees and costs incurred by Topshelf Merch for any such infringement. By supplying images, designs or other material to Topshelf Merch, the approving party grants Topshelf Merch the non-exclusive right and license to display, copy, publish, distribute, modify, transmit, print, and use such images, designs, or other material for your order.
